2.1 Content:

All the elements that make up the graphic design of this website, the menus, the navigation buttons, the source code, the texts, the images, the photographs, the textures, the graphics, the animations, the videos and any other content are the property of Dentared Odontology Services S.L., but not the trademarks, distinctive signs, domain names and trade names. Likewise, those corresponding to sponsors, advertisers, etc. that appear on this website are not its property.

Therefore, all rights of total or partial reproduction, modification, adaptation, public communication, computer processing, distribution, transformation, assignment, sale, rental, loan and/or any other intellectual or industrial property right that may correspond to the owner regarding the contents of the website are reserved. The exercise of the aforementioned rights is subject to the prior written authorisation of the owner.

The owner undertakes to correct, as soon as it becomes aware of them, any formal or numerical errors that may be found in the content of the various sections of the site.

Access to this site does not in any way imply the acquisition by the user of any property right over the contents that appear on it, which may therefore not be used for any purpose whatsoever. The improper use of these contents by the user will make the user solely responsible, towards the owner and third parties, for the damage caused, as well as for any violations of the law that may arise from it.

By providing your contact details, you agree to receive information about our services. The sending of these commercial communications about activities, services, offers, special promotions, etc. may be carried out by any means, including email.

5.1 Technical failures

2. Purpose of data processing

We inform you that the data you provide us is processed for the purpose of managing a personal account with a single registration for the use of the website to purchase the products offered on it, managing orders, invoicing and marketing our products, attending to and responding to requests for information and/or questions received, managing the subscription to our Newsletter for sending information about our products and offers that may be of interest to the user, as well as facilitating, speeding up and fulfilling the commitments established between the Owner and the User and maintaining the relationship that has been established.

Likewise, in accordance with the provisions of the GDPR, a record of processing activities is kept which specifies, according to its purposes, the processing activities carried out and the other circumstances established in the GDPR. Personal data may not be used for purposes other than those related to the contracted services or the products purchased. No automated decision will be taken on the basis of this profile.

The personal data we process has been provided by the user themselves by sending emails or by using the functionalities offered on the portal.

The use of the contact sections, the completion of the forms and/or functionalities offered on the portal is voluntary. However, the completion of certain fields of the form or its provision through the use of other functionalities is necessary to correctly process and manage the request, so that the user's refusal to provide the required information will prevent Dentared Odontology Services S.L. from correctly processing and managing their request. The user guarantees that the data provided is truthful, accurate and complete. The data will be cancelled, deleted or blocked when it is inaccurate, incomplete or no longer necessary or relevant for its purpose, in accordance with the legislation in force. 5. Retention period for personal data

The personal data provided by the user will be kept as long as the user remains registered for the service, as long as the commercial relationship is maintained, as long as the user does not request its deletion, or for the legally established period. It may also be kept when necessary to comply with a legal obligation or for the formulation, exercise and defence of legal claims.

If the user revokes their consent or exercises their rights of objection or deletion, their data will be blocked at the disposal of the Administration of Justice for the legally established periods in order to respond to any liabilities arising from the processing of personal data.

PURCHASE CONDITIONS

These general contract conditions (hereinafter GCC) govern the purchase conditions of the various products offered on our website: www.dentaltix.com, owned by DENTARED ODONTOLOGY SERVICES, S.L. (hereinafter DENTALTIX), a Spanish company with NIF B86142809, and domiciled at 22 Place du Général Catroux, 75017, Paris - France.

Users who make purchases on www.dentaltix.com fully accept these GCC and will be bound by them, as if they had been written at the time of the conclusion of the contract/purchase.

It is essential to read and accept the GCC before purchasing any product on www.dentaltix.com.

DENTALTIX reserves the right to modify the GCC at any time and without prior notice. The GCC will always be accessible from the website, so that the user can consult or print them at any time.

Prices and conditions of sale are given for guidance only and may be modified according to market fluctuations. However, placing an order by completing the purchase form implies acceptance of the price offered and the general conditions of sale in force at that precise moment. Once the order has been formalised, the purchase will be considered fully completed, with all the legal guarantees that protect the consumer purchaser. The language used to formalise the contract is French. The electronic document in which the contract is formalised will be archived and the user will have access to it in their customer area.

DENTALTIX reserves the right to refuse and/or suspend access to the services provided on www.dentaltix.com for reasons of breach of contractual good faith, applicable legislation, these general purchase conditions and/or in the event of suspected fraud detected by this company and/or any of its suppliers.

DELIVERIES:

  • The delivery times for most of our products are 4 to 6 working days. Our products are shipped by our suppliers who are based in Madrid, Spain.
  • Deliveries are made from Monday to Friday (working days).
  • The delivery process will begin once the payment of your order is confirmed. In the case where you have made the payment by bank card, by Paypal or by direct debit. The delivery times are counted from the moment you complete the purchase. If you have chosen bank transfer as the payment method, the delivery times are counted from when we receive the transfer. In order to speed up the processing of your order, you can deposit the money into our bank account; in this way the confirmation of payment is immediate.
  • Some products have a different delivery time and in this case the time appears on the product sheet.
  • Delivery times are always approximate; in 95% of cases they are met, but it must be taken into account that the carriers are on the road and it is not always possible to meet the deadlines.

WITHDRAWAL :

To this end, DENTALTIX informs you that the consolidated text of the General Law for the Defence of Consumers and Users (TRLGDCU, by its acronym in Spanish) establishes several options for exercising the right of withdrawal. One of them is the possibility of doing so by completing an online form. In order to shorten the deadlines and allow you to make the return conveniently and without delay, DENTALTIX advises you to use this option and complete the withdrawal form.

In accordance with the legislation in force, you may proceed with the termination of the contract, without having to justify this decision and without any penalty whatsoever, within a period of 14 calendar days from the customer's receipt of the goods. To do so, the conditions set out in this document must be met: Withdrawal form

The consumer is only responsible for any depreciation of the goods resulting from handling of the goods other than that necessary to establish their nature, characteristics or functioning.

The right of withdrawal does not apply to contracts relating to:

  1. The provision of services, once the service has been fully performed, and if the contract imposes a payment obligation on the consumer or user, when performance has begun, with the prior express consent of the consumer or user and in the knowledge that once the professional has fully performed the contract, they will have lost their right of withdrawal.
  2. The supply of goods or services whose price depends on fluctuations in the financial markets that are beyond the control of the entrepreneur and that may occur during the withdrawal period.
  3. The supply of goods made to the consumer and user's specifications or clearly personalised.
  4. The supply of goods that are liable to deteriorate or expire rapidly.
  5. The supply of sealed goods that cannot be returned for reasons of health protection or hygiene and that were unsealed after delivery.
  6. The delivery of goods that, after delivery and given their nature, have become inseparably mixed with other goods.
  7. The supply of alcoholic beverages whose price was agreed at the time of conclusion of the sales contract and which cannot be delivered within 30 days, and whose actual value depends on market fluctuations beyond the control of the entrepreneur.
  8. Contracts in which the consumer and user has expressly requested the entrepreneur to visit them for urgent repairs or maintenance; if, during this visit, the entrepreneur provides services in addition to those specifically requested by the consumer or supplies goods other than spare parts necessarily used to carry out the maintenance or repair, the right of withdrawal must apply to these additional services or goods.
  9. The supply of sealed audio or video recordings or sealed software that have been unsealed by the consumer and user after delivery.
  10. The supply of daily newspapers, periodicals or magazines, with the exception of subscription contracts for the supply of these publications.
  11. Contracts concluded through public auctions.
  12. The provision of accommodation services for purposes other than housing, the transport of goods, car rental, food or services related to leisure activities, if the contracts provide for a specific date or period of performance.
  13. The supply of digital content that is not supplied on a material medium when performance has begun and, if the contract imposes a payment obligation on the consumer or user, when the following conditions are met:
  • The consumer or user has given their prior consent to the commencement of performance during the period of the right of withdrawal.
  • The consumer or user has stated that they knew that they consequently lost their right of withdrawal.
  • The entrepreneur has provided confirmation in accordance with article 98.7 or article 99.2.

Once we have received the product(s), we will refund you according to the payment method you used:

  • If you paid by credit card, we will credit your account.
  • If you paid by PayPal, we will credit your PayPal account.
  • If you paid by bank transfer, we will ask you for an account number to credit your account. Please note that it may take up to two working days before your bank account is credited, due to bank float.

In any event, the legislation provides for a period of 14 calendar days to proceed with the refund of the amounts paid by the consumer and user.

Your liability is only engaged with regard to the depreciation of the goods resulting from handling of the goods other than that necessary to establish its nature, characteristics or functioning.

Dentaltix will take care of the collection of the product you wish to return. You must protect the product properly for shipping. Dentaltix will not be responsible for returns that arrive damaged at our warehouse because they were not properly packaged for shipping. We recommend that you place the products in a box that serves as protective packaging in order to prevent the product or its box from being damaged during transport. You can use, for example, the same cardboard box in which we sent you the product or an equivalent box.

In all cases, it is recommended to photograph the condition of the goods and the package before shipping, in case they are damaged during transport.

RETURN CONDITIONS FOR PRIVATE CUSTOMERS

  • You have a period of 15 calendar days from receipt of the goods to request a return, beyond the legal period for exercising the right of withdrawal. You may do so for any reason, but remember that it is essential that the product and its packaging are not altered. For reasons of safety and health, products whose security seal is opened cannot be returned.
  • After receipt of the goods and verification of their perfect condition, the amount of the returned product will be refunded.
  • Return of products with a gift or promotion: it will be mandatory to return the complete product (complete pack or item + gift) in order to proceed with the refund. In the case of products including discount codes, these will be taken into account at the time of the refund, reducing it by the proportional part.

RETURN CONDITIONS FOR COMPANIES

  • Only returns of unsealed material in perfect condition will be accepted within 15 calendar days of receipt.
  • Returns will be treated as commercial returns, given that no law governs return rights between companies, and that these procedures are governed by the DENTALTIX conditions.
  • We do not accept returns of products in blister packs or heat-sealed packaging, nor other products whose factory security seal has been broken. For reasons of safety and health, products whose security seal is opened cannot be returned.
  • These conditions do not cancel the right to guarantee or exchange of defective products. DENTALTIX reserves the right to refuse the return in the event of an anomaly detected in the returned product.

WARRANTIES

The products sold on Dentaltix have a warranty period of 6 months to 2 years from the date of invoice, as established by the manufacturer. It will be the responsibility of the manufacturer's technical service to determine whether the product can be repaired by exchanging the parts that have a manufacturing defect, or its total replacement in the event that the product is not repairable.

For certain products, the warranty may be longer than the legally established warranty (EU Regulation 2017/745 on medical devices), this option being the sole responsibility of the manufacturer.

The warranty is offered by the manufacturer and covers any manufacturing defects of the product, as well as any incident that the product may present as a result of a manufacturing defect, during the indicated period.

Excluded from the warranties are consumable products, failures resulting from improper use or maintenance of the product, as well as those caused by improper handling or incorrect installations.

ORDER CANCELLATIONS

Order cancellations that involve a refund to the customer and that are made by bank transfer have a maximum period of 30 days for administrative procedures, although we strive to limit this period to 7 days.
